My job description is "xxx mathematician" on the I-140, but what I'm actually doing is developing and supporting scientific programs. The industry is not IT. If I switch back to IT, could it still be "similar job"?

Matthew Oh is reporting that the USCIS is planning to deny EAD applications filed more than 120 days before expiry. Source is described as correspondence to AILA from the USCIS. Hmmm!
I thought I read somewhere on their website that we should apply 180 days before expiry.

if your LLC is sponsoring your GC petition, then it is not possible. Your EAD will have certain conditions for employment, usually in the same line of work as the Labor Cert. Unless of course if you are a dependant EAD, then there are no restrictions on your employment opportunities.

I think one always has to take PR claims with a few grains of salt (yes, including Canon's). As always, I'll wait for the reviews to come out before making any judgements, but I'm afraid unless Nikon does something about their lack of ultra-long primes with VR and their lack of any usable PC lenses, I'm going to be a Canon convert (if / when I go DSLR).

Dear all,
I just realized that my lawyer forgot to mention A# in my 485 application. I have an approved I140 and the approval notice does have A# mentioned on it.
Does any one in this forum know if I am in trouble? I have sent a copy of my I-140 approval notice in my application though.
Any thoughts/experience?

I am planning to file H1 petition through a sponsor . I am having questions for h1 duration and initial h1 approval time, here is my details :
I am on L1 right now and my L1 stay in US is :
Apr'07 - Dec'07 - 9 months
Jan'08 - Mar'09 - Was in india
Mar'09 - till date - ~13 months.
Now my questions are :
1) If I apply for h1, how much time I can stay on h1 considering L1 stay as well ?
2) How much time initially h1 could be approved before doing h1 extension for another 3 years ?

Hello,
I spoke to my lawyer today and she made it very clear that it is ILLEGAL to file more than one I-485 for one applicant (from 2 diff companies). USCIS will immediately ask you to make a choice.

I always have to switch between forward and a left or right perspective in order to do that. Even then it's hard to get it just right.

Hi,
I am currently on H1B with an employer who has processed GC so far (labor and 140 are approved)
Currently I have all documents except
1)Approved 140
2) Employement offer letter
For 140, I have courtesy copy.
Employer is asking lot of money to file 485 all of a sudden. And they are not responding to my calls for offer letter.
So I was planning to apply 485 by myself or hire an attorney other than my company's.
Since I dont have above mentioned documents, can I still apply 485 without being denied?
Please help me

Take an Inpass Appointment and Meet local USCIS officer and ask for help... Letter or Duplicate EAD. If you have a Job Offer letter they Might expedite the EAD Request..

Hello everyone,
I am in a very bad condition n would appreciate anyone who can advice me on same. I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks
Lawyer is right. If you leave the country, you will be barred for 10 years from re-entry if you accumulated more than 1 year of "unlawful presence" ("out of status" is different and it is not a such a big deal to lose status as long as you do not accumulate unlawful presence). If you stay, you may be able to eventually get green card.
Can you provide more details regarding your timeline? Was I-485 filed? If you had pending I-485, "unlawful presence" counts from the date I-485 has been denied, not from the date H1 has expired.
